These terms and conditions apply to Booking.com Gift Cards (Gift Cards and E-gift Cards) issued by Booking.com B.V.. Booking.com B.V. (hereafter referred to as “Booking.com”) is a private limited company organised under the laws of the Netherlands, and owns and operates the platform www.booking.com. Furthermore, Booking.com may be the issuer of Gift Cards. By purchasing or using a Gift Card, you are agreeing to and accept these terms and conditions.
Redemption: Gift Cards may only be redeemed toward the purchase of eligible products on www.booking.com by transferring the balance to the Booking.com Wallet. In order to redeem the Gift Cards, an account with Booking.com is necessary. Purchases are deducted from the redeemer's Booking.com Wallet balance. Any unused balance will remain associated with the redeemer's Booking.com account and applied to purchases in order of earliest expiration date. If a purchase exceeds the redeemer's Booking.com Wallet balance, the remaining amount must be paid with another available payment method. Booking.com may provide Gift Card purchasers with information about the redemption status of Gift Cards that they purchase or use. To view your Gift Card balance, visit booking.com/giftcard. No fees or charges apply to Gift Cards. Gift Cards are valid only for users who are 16 years of age or older. For people younger than 16 years old, the use of any of Booking.com services is only allowed with the valid consent of a parent or a guardian. Booking.com may collect and use information of children only as provided by the parent or guardian and/or with their prior written explicit consent. If we become aware that we process information of a child under 16 years old without the valid consent of a parent or guardian, we reserve the right to delete this information.
Limitations:Gift Cards, including any unused Gift Card balances transferred to the Booking.com wallet, expire 3 years from the date of issuance. Gift Cards may only be purchased based on limits as Booking.com (including the Gift Card provider) may determine. Gift Cards cannot be used to purchase other gift cards. Gift Cards cannot be reloaded, resold, transferred for value or redeemed for cash. Gift Cards that have already been purchased cannot be returned for a refund. Unused Gift Card balances associated with a Booking.com account may not be transferred to another Booking.com account. No interest will be payable by Booking.com (including Gift Card provider) on any Gift Card or Gift Card balance.
Risk of Loss: The risk of loss and title for Gift Cards pass to the purchaser upon our electronic transmission of the Gift Card to the purchaser or designated recipient, or our delivery to the carrier, whichever is applicable. Booking.com (including Gift Card provider) is not responsible if a Gift Card is lost, stolen, destroyed or used without your permission. Booking.com is not responsible for typos in recipient email addresses and may not refund users who send Gift Cards to the incorrect recipient. There are a variety of Gift Card scams that request payment by Gift Card. Booking.com is not responsible for, and assumes no liability to you for, any unlawful conduct or fraud by any third party associated with any Gift Card. Do not accept Gift Cards with damaged/scratched PINs.
Fraud: Booking.com will have the right to close customer accounts and take payment from alternative forms of payment if a fraudulently obtained Gift Card is redeemed and/or used to make purchases on its platform.
Use of Booking.com Balance or any Gift Card in Violation of these Terms and Conditions: By using a Gift Card you agree to comply with these terms and conditions, and not to use a Gift Card in any manner that is misleading, deceptive, unfair, or otherwise harmful to Booking.com, its affiliates, or its customers. Booking.com reserves the right, without notice to you, to void Gift Cards (including as a component of your Booking.com Balance) without a refund, suspend or terminate customer accounts, suspend or terminate the ability to use our services, cancel or limit orders, and bill alternative forms of payment, if we suspect that a Gift Card is obtained, used, or applied to an Booking.com account (or your Booking.com Balance is applied to a purchase) fraudulently, unlawfully, or otherwise in violation of these terms and conditions.
Governing Law and Jurisdiction: These terms and conditions are governed by and construed in accordance with the laws of The Netherlands. You and Booking.com each agree to submit to the exclusive jurisdiction of the courts at The Netherlands. You agree to indemnify Booking.com (including Gift Card provider) for all claims brought by a third party against it or its affiliates arising out of or in connection with a breach of any of these terms and conditions.
Limitation of Liability: We make no warranties, express or implied, with respect to gift cards, including without limitation, any express or implied warranty of merchantability or fitness for a particular purpose. In the event a gift card is non-functional, your sole remedy, and our sole liability, will be the replacement of such gift card. If applicable law does not allow limitations on implied warranties or the exclusion or limitation of certain damages, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you may have additional rights.
General Terms: Booking.com reserves the right to change these Gift Card terms and conditions from time to time in its discretion and without prior notice to you. All terms and conditions are applicable to the extent permitted by law.
